79th District Court releases recent indictments

A Falfurrias man who was the driver in a single-vehicle accident in which a 5-year-old boy was killed last year has been indicted for intoxication manslaughter, according to court records.

Rodolfo Rene Garza Jr. was indicted April 13 on both charges, according to records just released by the 79th District Court.

The intoxication manslaughter indictment alleges Garza caused the death of Juan Luis Alejandro Galindo, 6, in a March 27, 2006 accident.

Garza was also indicted for intoxication assault for allegedly causing injury to a second individual, identified as Victoria V. Vasquez.

According to the Department of Public Safety officials, the accident occurred on County Road 401, near Premont. Garza was driving a 2000 Chevrolet Cavalier at a high rate of speed eastbound on the county road, records show, with three passengers.

Those passengers included Galindo, Vasquez and a 1-year-old girl.

DPS officials at the scene said Garza lost control of the vehicle and over-corrected, causing the car to strike a fence and roll over twice.

Galindo, who was the only passenger not wearing a seat belt, was ejected from the vehicle and was killed.

The following indictments were also released by the 79th District Court Wednesday.

Rolando Pena was indicted for sexual assault in connection with a March 14, 2006 incident in which he allegedly assaulted a woman. Rodolfo Rios was indicted for indecency with a child in connection with a July 14, 2006 incident in which he allegedly had inappropriate contact with a girl under the age of 17 years. Ashley Nicole Ponce was indicted for two counts of aggravated assault in connection with an April 23, 2006 incident in which she allegedly stabbed two other women with a knife. Esequiel Gutierrez Jr. was indicted for possession of heroin in connection with a Nov. 17, 2006 incident in which he was allegedly found in possession of less than one gram of heroin. Adan Trevino Jr. was indicted for evading arrest with a vehicle in connection with a Nov. 18, 2006 incident in which he allegedly attempted to flee from a peace officer. Terence L. Mann was indicted for possession of cocaine in connection with a Feb. 23 incident in which he was allegedly found to be in possession of less than one gram of cocaine. Michael Charles was indicted for possession of cocaine in connection with a July 1, 2006 incident in which he was allegedly found to be in possession of less than one gram of cocaine. Rene Buentello was indicted for possession of cocaine in connection with an Oct. 16, 2005 incident in which he was allegedly found to be in possession of less than one gram of cocaine. David Zuniga was indicted for forgery in connection with a Feb. 11, 2006 incident in which he allegedly forged a check.
