An Orange Grove woman is still listed in critical condition, Jim Wells County Sheriff's Department investigators said, after her boyfriend of three years allegedly shot her in the right shoulder with a .22 magnum pistol on Oct. 6.

David Keith Womack, 21, of Orange Grove was arrested by Jim Wells County Sheriff's Department Investigator Gino Martinez and charged with aggravated assault with a deadly weapon.

Martinez would not release the name of the 30-year-old victim until he has the opportunity to question her.

He said she was still under heavy sedation at the hospital because of the shooting, and hadn't had the opportunity to get her side of the story.

The case is still under investigation by the sheriff's department, but Martinez said as best as they could piece together so far, Womack and the victim were outside of their mobile home last Saturday night, with four other individuals, including one child.

Martinez said there was drinking involved in the incident.

Womack was sighting in a .22 magnum pistol, when he shot the victim once on the right side, beneath the collarbone. Womack alleges he and his girlfriend were not arguing at the time of the shooting, Martinez said.

All four witnesses and Womack stated to Martinez that the shooting was an accident. Womack was taken into custody and released on Monday from the Jim Wells County jail on a $2,000 surety bond magistrated by Justice of the Peace Jose Rodriguez.
