A Jim Wells County grand jury has indicted a former Orange Grove police officer for theft, in connection with a construction business the officer ran in 2006 and 2007.

Frank Jaramillo Jr. was indicted for theft in connection with a Sept. 5, 2006 incident in which he allegedly stole money from Vilma Gaza.

Gaza filed a lawsuit against Jaramillo and his business partner in December 2006. In that lawsuit, Gaza alleged Jaramillo, through his construction service Foundation Repair, worked to perpetrate fraud by accepting money for a job which he never intended to finish.

During the early summer of 2006, according to the petition, Jaramillo and his business partner made several visits to Gaza's home in Alice for the purpose of soliciting construction repair work. At various times during the visitations, both reassured Gaza she should trust Foundation Repair because Jaramillo was an Assistant Police Chief, the suit stated.

On June 14, 2006, Gaza was presented with a contract for the project. The contract specifies that the work would be completed in 21 days. The petition said based on the representations made by the defendants and the defendants' association with the City of Orange Grove Police Department, the plaintiff signed the contract and paid the defendants half of the contract sum, $11,750.

Prior to filing the lawsuit, Gaza reported the incident to the Alice Police Department, and it was labeled a theft case in the amount of $11,750, which was paid to Foundation Repair in two checks given to Jaramillo, according to the report.
